Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Webward, operated by Webward LLC (“Webward,” “we,” “us,” or “our”). By using Webward, you agree to these Terms.
1. The service
Webward is a service that builds websites for small businesses through an AI-assisted conversation, including via SMS where available. The service includes website generation, hosting, editing, and related features.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract to use Webward. You must provide accurate information about yourself and your business.
3. Your account
You’re responsible for activity on your account. Keep your phone number and any login credentials secure. Tell us promptly if you suspect unauthorized use.
4. Acceptable use
You agree not to use Webward to:
- Create or distribute content that is illegal, deceptive, fraudulent, or that violates anyone’s rights.
- Promote scams, phishing, malware, or otherwise harmful content.
- Impersonate any person or business other than your own.
- Send unsolicited messages, spam, or use the service for unauthorized commercial purposes.
- Attempt to reverse engineer, scrape, or interfere with the service.
- Use Webward to compete directly with us by reselling our generated output.
We may suspend or terminate accounts that violate these rules without refund.
5. SMS messaging terms
If you contact us via SMS or opt in to receive SMS:
- You consent to receive recurring messages from Webward at the phone number you provided. Message frequency varies. Message and data rates may apply.
- To opt out, reply STOP at any time. We will confirm your opt-out and stop sending messages, except a single confirmation.
- For help, reply HELP or email [email protected].
- We use third-party providers (such as Twilio) to deliver SMS. Their performance and your carrier’s policies affect message delivery; we are not responsible for messages that fail to deliver.
- Carriers are not liable for delayed or undelivered messages.
6. Content you provide
You retain ownership of the information you give us about your business. You grant Webward a worldwide, non-exclusive license to use that information solely to operate the service — including to generate, host, edit, and display the website you asked us to make.
You represent that you have the right to provide the information and that the resulting website will not infringe anyone’s rights.
7. Content we generate
When Webward generates a website for you, you receive a license to use, display, host, and modify that output for your business. You can export the source files at any time.
8. Fees and billing
Some features are paid. Pricing will be presented to you before you commit. Fees are billed in advance, are non-refundable except where required by law, and may change with notice.
9. Termination
You may stop using Webward at any time. We may suspend or terminate your access if you violate these Terms or for legitimate operational reasons. On termination, your right to use the service ends; some sections of these Terms survive.
10. Disclaimers
Webward is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, and non-infringement.
We don’t promise the service will be uninterrupted, error-free, or that the AI-generated content will be perfectly accurate. You’re responsible for reviewing your website before using it for business.
11. Limitation of liability
To the fullest extent permitted by law:
- Webward will not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim relating to the service is limited to the greater of (a) what you paid us in the 12 months before the event, or (b) one hundred US dollars ($100).
12. Indemnification
You agree to indemnify and hold Webward harmless from any claim arising out of (a) your use of the service, (b) the information you provide, (c) your website’s content, or (d) your violation of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be resolved in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts.
14. Changes
We may update these Terms. The “Last updated” date at the top will reflect the most recent change. Continued use of the service after changes means you accept them.
